Man denied bail

A Sandy Bay First Nation man who is facing charges of break and enter has been denied bail.
When he appeared in Portage la Prairie provincial court on Oct. 19, Timothy Joseph Spence, 21, made a request for release.
He is facing eight counts of break and enter on Aug. 18, 2007, for incidents in the Peony Farm area in Portage. He is also facing charges of breaching his curfew on Aug. 18, 2007; failing to appear in court on Sept. 24, 2007, and Aug. 11, 2008; failing to report to his probation officer on Feb. 23, 2009; and breaching a recognizance order on Oct. 10, 2009.
Crown attorney Carli Owens reported the accused was in breach of a recognizance order when he was arrested on Oct. 10, in a Portage coffee shop after being under a court order not to enter Portage.
Defence attorney Chad Schaan said his client has some breaches to face, but has been in no substantive trouble with the court since 2007.
Schaan also commented Spence had been living in Winnipeg for a period of time before moving back to Sandy Bay.
Judge Jean McBride noted Spence has a trial set for Nov. 12 for a number of break-and-enter charges.
She also remarked as an aggravating factor, Spence allegedly has not fulfilled his obligation to come to court in the past and failed to report to his probation officer.
"I am not confident you will come to court and deal with the charges," said the judge.
Spence's case is due back in court on Nov. 12.
